Nhân ngày Quốc Hận 30-04-1980, tại tiền đình Tòa Đô Chánh San Francisco, nhân danh Hội Luật Gia Việt Nam tại California, Luật Sư Nguyễn Hữu Thống đã gởi bản Thông Điệp Ngày Quốc Hận cho Luật Sư Nguyễn Hữu Thọ, đương kim Chủ Tịch Nhà Nước Cộng Hòa Xã Hội Chủ Nghĩa Việt Nam.

Trong chuyến công du và thăm viếng đồng bào tại Thái Lan, để trả lời câu chất vấn của báo chí về việc Đảng Cộng Sản bắt giam trái phép tại các trại cải tạo hàng trăm ngàn trí thức văn nghệ sĩ, quân nhân, công chức và cán bộ Việt Nam Cộng Hòa trong thời gian vừa qua, Luật Sư Thọ đại diện Nhà Nước đã ngụy biện rằng: những phần tử ngụy quân ngụy quyền này đáng lẽ đã bị thanh toán đồng loạt. Tuy nhiên do chính sách khoan hồng của Đảng và Chính Phủ, chúng tôi chỉ tập trung họ trong các trại cải tạo để giáo dục họ về đường lối chính sách của Đảng thay vì phải thẳng tay trừng trị.

Để trả lời luận điệu ngoan cố này, Luật Sư Thống đã gởi Luật Sư Thọ bản Thông Điệp Ngày Quốc Hận, nguyên văn như sau:

Nhân ngày Quốc Hận 30 tháng 4 năm 1980, thay mặt Hội Luật Gia Việt Nam tại California, trụ sở tại Vùng Vịnh Cựu Kim Sơn, Luật Sư Nguyễn Hữu Thống tuyên đọc bản Thông Điệp Ngày Quốc Hận gởi Luật Sư Nguyễn Hữu Thọ, Chủ Tịch Nhà Nước Cộng Hòa Xã Hội Chủ Nghĩa Việt Nam để cảnh giác Luật Sư Thọ và Chính Phủ Hà Nội về một số nguyên tắc pháp lý cơ sở được coi là nền tảng tổ chức và sinh hoạt tại các quốc gia văn minh trên thế giới.

1. QUYỀN ĐƯỢC SUY ĐOÁN LÀ VÔ TỘI

Theo Tuyên Ngôn Quốc Tế Nhân Quyền Liên Hiệp Quốc, mọi người đều được hưởng quyền suy đoán vô tội cho đến khi có đủ bằng chứng phạm pháp trong một phiên xử công khai tại tòa án với đầy đủ bảo đảm cần thiết cho quyền biện hộ.

Hơn nữa không ai có thể bị bắt giữ, giam cầm hay lưu đày độc đoán về một tội hình sự do những điều đã làm, nếu những điều này không cấu thành tội hình sự chiếu luật pháp quốc gia hay luật pháp quốc tế, luật pháp quốc tế là những nguyên tắc luật pháp tổng quát được thừa nhận bởi cộng đồng các quốc gia văn minh (như Tuyên Ngôn Quốc Tế Nhân Quyền 1948 hay Công Ước Quốc Tế về Những Quyền Dân Sự và Chính Trị do Liên Hiệp Quốc biểu quyết thông qua năm 1966 và đã có hiệu lực chấp hành từ 1976).

Đã từng hành nghề, Luật Sư Thọ chưa thể quên nguyên tắc suy đoán vô tội của người dân. Quyền này phải được áp dụng cho hàng trăm ngàn quân cán chánh và trí thức văn nghệ sĩ Việt Nam Cộng Hòa. Những người này không phạm tội hình sự nào nên không thể bị bắt giam, và làm lao động khổ sai để đọa đày thân xác. Trong chiến tranh vừa qua, họ chỉ thi hành nghĩa vụ công dân là bảo vệ đất nước và chế độ cộng hòa dân chủ chống chiến tranh xâm lược do Quốc Tế Cộng Sản phát động qua Đảng Cộng Sản Việt Nam.

Nếu vì địa vị hay không tưởng mà lãng quên nguyên tắc này thì Luật Sư Thọ ngày nay là kẻ lầm đường lạc lối và đã phản bội lời tuyên thệ khi gia nhập Luật Sư Đoàn Sàigòn cam kết sẽ thượng tôn Luật Pháp, bảo vệ Công Lý và những nguyên tắc hành nghề căn bản của người luật sư như Chính Trực, Vô Tư và Ôn Hòa.

2. QUYỀN TỰ DO NHÂN THÂN

Cũng theo Tuyên Ngôn Quốc Tế Nhân Quyền mọi người sinh ra tự do và bình đẳng và phải đối xử với nhau trong tình bác ái. Mọi người đều có quyền sống, quyền tự do thân thể và an ninh thân thể. Không ai có thể bị tra tấn hành hạ và bắt giam độc đoán. Không ai có thể bị câu thúc lưu đày hay hành quyết nếu không có bản án chung thẩm kết tội do một tòa án độc lập tôn trọng quyền biện hộ của bị cáo. Những quyền này phải được áp dụng cho các tù nhân chính trị mệnh danh là tù cải tạo.

Khi cuộc Nội Chiến Hoa Kỳ kết thúc, những người thắng trận Miền Bắc cũng không hành hạ, bắt giam, nhục mạ hay tước đoạt tự do và tài sản của các đồng bào thất trận Miền Nam.

2. QUYỀN TỰ DO ĐI LẠI VÀ XUẤT NGOẠI

Đây là một trong những quyền bất khả xâm phạm của con người được quy định trong Tuyên Ngôn Quốc Tế Nhân Quyền:

Ai cũng có quyền tự do đi lại và cư trú trong lãnh thổ quốc gia. Ai cũng có quyền xuất ngoại và hồi hương.

Hiện nay Chính Phủ Hà Nội đã trắng trợn vi phạm những quyền tự do căn bản này bằng cách tước đoạt quyền sống, quyền tự do xuất ngoại của hàng trăm ngàn đồng bào đã phủ nhận cái sống để cầm cái chết vượt biển ra đi.

Hơn nữa hàng chục ngàn đồng bào khác có thân nhân tại hải ngoại, đã hoàn tất thủ tục đoàn tụ gia đình nhưng hồ sơ của họ vẫn bị Nhà Nước ếm nhẹm hay bác bỏ vô duyên cớ.

VÌ NHỮNG LÝ DO NÓI TRÊN

Chúng tôi, Hội Luật Gia Việt Nam tại California gồm 106 hội viên, bằng Thông Điệp này, long trọng cảnh giác Luật Sư Nguyễn Hữu Thọ, Chủ Tịch Nhà Nước Cộng Hòa Xã Hội Chủ Nghĩa Việt Nam về các nguyên tắc pháp lý, tinh thần và đạo lý nêu trên. Đồng thời khuyến cáo Luật Sư Nguyễn HữuThọ hãy dùng thẩm quyền nếu có của mình để:

1. Tôn trọng Quyền Sống, Quyền Tự Do Thân Thể và An Ninh Thân Thể bằng cách trả tự do cho các lương dân vô tội còn bị câu thúc, giam giữ và lưu đày tại các trại tập trung và lao động cưỡng bách mệnh danh là trại cải tạo.
2. Tôn trọng Quyền Tự Do Đi Lại và Tự Do Xuất Ngoại của đồng bào có thân nhân muốn đoàn tụ gia đình tại quốc ngoại.

TESTIMONIAL FOR PRISONERS OF CONSCIENCE
NGUYEN HUU THONG, ESQ.
MESSAGE FROM ATTORNEY NGUYEN HUU THONG TO ATTORNEY NGUYEN HUU THO ON THE NATIONAL DAY OF SHAME 1980

On April 27, 1980, in commemoration of the National Day of Shame, Attorney Nguyen Huu Thong sent a message from the vestibule of San Franciscos City Hall to Attorney Nguyen Huu Tho, current President of the Socialist Republic of Vietnam, on behalf of the California Vietnamese Lawyers Association, Inc.

During Attorney Nguyen Huu Thos official visit to Thailand, the press corps asked him about the fact that the Vietnamese Communist Party had recently illegally imprisoned hundreds of thousands of intellectuals, writers, artists, military personnel, public servants, and cadres of the Republic of Vietnam in reeducation camps. Attorney Tho, as spokesman for the Government, used specious reasoning to declare that: In fact, these rebellious elements should have been eliminated en masse. However, thanks to the extraordinary leniency of the Government, we have only gathered them in reeducation camps to educate them in the ways of our Government policy instead of punishing them harshly.

In response to this outrageous argument, on April 27, 1980 on behalf of the California Vietnamese Lawyers Association, which is headquartered in San Jose, California Attorney Nguyen Huu Thong openly read the 1980 National Day of Shame Message that he had sent to Attorney Nguyen Huu Tho, President of the Socialist Republic of Vietnam. He did so to raise the awareness of Attorney Tho and of the Hanoi Government regarding several basic legal principles that are considered to be the foundation for the organization and activities of civilized countries around the world.

THE RIGHT TO THE PRESUMPTION OF INNOCENCE

According to the Universal Declaration of Human Rights of the United Nations, all individuals have the right to be presumed innocent until all the evidence of guilt is presented in a public trial to a court, with all the necessary guarantees for the rights of the defense.

In addition, no individual can be arrested, detained, or exiled arbitrarily for alleged criminal acts unless those acts constitute a crime according to national or international codes of law, where international laws are general principles recognized by the international community of nations. These principles include those that are stipulated in the Universal Declaration of Human Rights of 1948 and the International Covenant on Civil and Political Rights which the United Nations passed in 1966 and ratified in 1976.

Having practiced as a lawyer at the Saigon Court of Appeals, Attorney Tho cannot possibly have forgotten the principle of presumption of innocence. This right must be applied to hundreds of thousands of soldiers, cadres, intellectuals, writers, and artists from the Republic of Vietnam. These people have committed no crimes and, therefore, should not be imprisoned or forced to do physically destructive hard labor in reeducation camps. In the recent war, they only carried out their civic duty to protect their country and the regime of the democratic republic against an aggressive invasion by the International Communists acting through the Vietnamese Communists.

Today, because of his position or for utilitarian reasons that have led him to forget this principle, Attorney Tho has lost his way. He has betrayed the pledge he made when he joined the Bar Association of Saigon to uphold the Law, protect Justice, and honor the spiritual principles such as Truthfulness, Impartiality, and Conciliation which guide members of the legal profession.

THE RIGHT TO PERSONAL LIBERTY

The Universal Declaration of Human Rights also stipulates that all individuals are born free and equal and must treat one another in the spirit of fraternity. Everyone has the right to life, the right to liberty, and security of person. No one should be tortured or detained arbitrarily. No one should be detained, exiled, or executed without indictment of the highest instance by an independent court which respects the accused 's right to defend himself. These rights must be applied to all political prisoners in so called reeducation camps.
In the middle of the 19th Century, when the American Civil War ended, the victors from the North did not mistreat, imprison, humiliate, or seize the freedom and properties of the vanquished soldiers from the South.

THE FREEDOM OF RESIDENCE AND MOVEMENT, AND THE FREEDOM TO TRAVEL ABROAD

These freedoms constitute inalienable rights of individuals and were unequivocally stipulated in the Universal Declaration of Human Rights.

Everyone has the right to freedom of residence and movement within the national territory. Everyone is free to travel abroad and to repatriate.

Currently, the Hanoi Government has flagrantly violated these basic rights to freedom by usurping the right to life and the freedom to travel abroad by hundreds of thousands of people who have rejected this government and risked their lives when escaping by boat.

Moreover, tens of thousands of others with relatives abroad have completed the procedures to reunite with their families, but their applications are delayed unnecessarily or rejected without proper justification.

FOR THE REASONS MENTIONED ABOVE

We, the California Vietnamese Lawyers Association, with a total membership of 106 attorneys, by this message solemnly remind Attorney Nguyen Huu Tho, President of the Socialist Republic of Vietnam, about the legal, spiritual, and moral principles listed above. At the same time, we recommend that Attorney Nguyen Huu Tho use his authority, if he has any, to:

Respect the Right to Life and the Right to Liberty and Security of Person by releasing the innocent, law-abiding citizens still detained, imprisoned, and arbitrarily exiled to concentration camps and forced labor camps euphemistically called reeducation camps.

Respect the Right to Freedom of Movement and the Right to Travel Abroad of people who have relatives overseas and want to reunite with their families.

LUẬT SƯ NGUYỄN HỮU THỐNG GỬI VĂN THƯ CHO TỔNG THỐNG FIDEL RAMOS VỀ VẤN ĐỀ LUẬT PHÁP VÀ TRẬT TỰ TẠI BIỂN ĐÔNG NAM Á

Ngày 14-07-1995, nhân kỳ Đại Hội ASEAN tại Brunei, Luật Sư Nguyễn Hữu Thống, Chủ Tịch Hội Luật Gia Việt Nam tại California đã gửi văn thư cho 7 vị nguyên thủ quốc gia trong Hiệp Hội các Quốc Gia Đông Nam Á là Phi Luật Tân, Mã Lai, Nam Dương, Brunei, Tân Gia Ba, Thái Lan và Việt Nam để trình bày về vấn đề giải quyết các vụ tranh chấp tại Biển Đông Nam Á theo những quy luật dự liệu trong Công Ước Liên Hiệp Quốc về Luật Biển 1982.

Theo các quan sát viên quốc tế, văn thư này đưa ra giải đáp ưu tiên hàng đầu cho vấn đề tranh chấp giữa Việt Nam và Trung Quốc. Bằng cách dùng phương thức tranh nghị để đi đến hòa bình. (The Discussion Proceeds for Peace).

Dưới đây là văn thư của Luật Sư Nguyễn Hữu Thống gửi Tổng Thống Phi Luật Tân Fidel Ramos:

Thưa Tổng Thống,

Nhân danh Hội Luật Gia Việt Nam tại California, chúng tôi xin trình bày cùng Tổng Thống vấn đề tranh chấp tại quần đảo Trường Sa.

7 năm trước đây, có trận hải chiến giữa Việt Nam và Trung Quốc tại vùng biển Trường Sa. Trong dịp này Trung Quốc đòi chủ quyền lãnh thổ tại các quần đảo Hoàng Sa và Trường Sa, và đã chiếm cứ một số hải đảo gây nên mâu thuẫn và tranh chấp giữa Trung Quốc với Việt Nam và Phi Luật Tân.

Mới đây Trung Quốc còn lấn chiếm một số cồn, đá, bãi toạ lạc tại thềm lục địa Phi Luật Tân như Mischief Reef, Half Moon Shoal, Sabina Shoal và Jackson Bank. Hành động này đe dọa an ninh toàn vùng Đông Nam Á và cản trở sự tự do giao thương tại Biển Nam Hải.

Từ 3 năm trước, Trung Quốc cũng xâm chiếm một vùng biển tại Bãi Tứ Chính (Vanguard Bank) mà họ gọi là Bãi Vạn An (Wanan Bei) để tự tiện nhượng quyền khai thác dầu khí cho Hãng Crestone. Vùng bãi này nằm trong Thềm Lục Địa Việt Nam cách bờ biển 190 hải lý về phía đông nam.

Phía đông Bãi Tứ Chính nơi Hãng Crestone đang khai thác dầu khí là quần đảo Trường Sa, đối tượng tranh chấp giữa Trung Quốc, Việt Nam, Phi Luật Tân, Mã Lai, Brunei, Nam Dương và Đài Loan.

Lưỡi Rồng Trung Quốc hình chữ U, mà Bắc Kinh gọi là “Đặc Khu Hành Chánh Hải Nam”, chiếm 80% Biển Nam Hải, phía đông giáp Phi Luật Tân, phía tây giáp Việt Nam và phía nam giáp Mã Lai, Brunei và Nam Dương, điểm xa nhất cách Hoa Lục 1,100 hải lý (hay 2000km). Hành động như vậy Trung Quốc coi Biển Nam Hải là nội hải của họ (internal waters), cũng như Đế Quốc La Mã ngày xưa gọi Địa Trung Hải là “Biển Của Chúng Tôi” (Mare Nostrum).

Chiếu Điều 57 Công Ước Liên Hiệp Quốc về Luật Biển, các quốc gia duyên hải có đặc quyền đánh cá tại Vùng Đặc Quyền Kinh Tế 200 hải lý (Exclusive Economic Zone).

Chiếu Điều 76 Công Ước Liên Hiệp Quốc về Luật Biển, các quốc gia duyên hải có đặc quyền thăm dò và khai thác dầu khí tại thềm lục địa (continental shelf) kéo dài từ 200 hải lý đến 350 hải lý, nếu về mặt địa hình, thềm lục địa là sự tiếp nối tự nhiên của nền lục địa (continental margin) từ đất liền ra ngoài biển. Về mặt pháp lý các quốc gia duyên hải đã ký kết hay tham gia Công Ước Liên Hiệp Quốc về Luật Biển đương nhiên được hưởng quy chế thềm lục địa pháp lý 200 hải lý. Đó là trường hợp của các quốc gia Đông Nam Á như Phi Luật Tân, Mã Lai, Nam Dương, Brunei, Tân Gia Ba, Thái Lan và Việt Nam (Việt Nam đã đăng ký thềm lục địa pháp lý 200 hải lý từ năm 1982).

Chiếu Điều 77 Công Ước Liên Hiệp Quốc về Luật Biển các quốc gia duyên hải có chủ quyền tuyệt đối tại thềm lục địa để thăm dò và khai thác những tài nguyên thiên nhiên. Đây là đặc quyền chuyên hữu theo đó không ai có quyền thăm dò và khai thác dầu khí nếu không có sự ưng thuận minh thị của quốc gia duyên hải. Những quyền này không tùy thuộc vào điều kiện phải có sự chiếm cứ hay công bố minh thị.

Điều 81 Công Ước Liên Hiệp Quốc về Luật Biển một lần nữa xác nhận chủ quyền tuyệt đối và đặc quyền chuyên hữu của quốc gia duyên hải trong việc tự mình đứng ra thăm dò và khai thác dầu khí, hay ký hiệp ước cộng tác với các quốc gia đệ tam về những dịch vụ này.

Chiếu nguyên tắc “các hiệp ước quốc tế phải được tôn trọng”, Điều 26 Công Ước Vienna về Luật Hiệp Ước (1969) quy định như sau: “Các hiệp ước có hiệu lực chấp hành buộc các quốc gia kết ước phải ngay tình thi hành hiệp ước”. Ủy Ban Liên Hiệp Quốc về Luật Quốc Tế coi đó là “một nguyên tắc căn bản về luật hiệp ước, có lẽ là nguyên tắc quan trọng nhất trong công pháp quốc tế”.

Chiếu nguyên tắc về giá trị thượng tôn của Luật Quốc Tế đối với Luật Quốc Nội, các quốc gia kết ước phải thực sự thi hành những quyến hạn và nghĩa vụ ghi trong các hiệp ước hay công ước quốc tế . Họ không thể viện dẫn luật quốc nội để khước từ thi hành nghĩa vụ của họ ghi trong các hiệp ước và công ước quốc tế mà họ đã ký kết hay tham gia.

Đó chính là trường hợp của Trung Quốc. Sau khi ký Công Ước Liên Hiệp Quốc về Luật Biển năm 1982, 10 năm sau, năm 1992, Bắc Kinh ban hành Luật Quốc Gia về Biển (Domestic Law of the Sea) xâm phạm chủ quyền lãnh thổ tại các Thềm Lục Địa Việt Nam và Phi Luật Tân, cũng như tại các quần đảo Hoàng Sa và Trường Sa.

Những vi phạm luật biển phải được đệ trình Tòa Án Quốc Tế (The Hague) hay các Tòa Án Luật Biển thiết lập do Công Ước Liên Hiệp Quốc về Luật Biển.

Muốn giải quyết những mâu thuẫn và tranh chấp về thềm lục địa, về hải phận hay về hải đảo, các quốc gia đương tụng phải, trước hết, tuân hành những phương thức ôn hòa như điều đình, hòa giải, thương nghị hay trọng tài.

Ngoài ra Tòa Án Quốc Tế cũng có thẩm quyền giải thích và áp dụng những điều khoản của Công Ước Liên Hiệp Quốc về Luật Biển có hiệu lực chấp hành từ năm 1994.

Sự giải quyết tranh chấp bằng những phương pháp ôn hòa như hòa giải, thương nghị, trọng tài hay tố tụng sẽ giúp cho Đông Nam Á khỏi biến thành vùng tranh chấp thường xuyên như Trung Đông. Với việc sử dụng luật pháp (pháp trị) thay thế việc sử dụng võ lực (phi pháp), Đông Nam Á sẽ có cơ may được hưởng một kỷ nguyên hòa bình, ổn định, hợp tác và phồn thịnh.

Nhân dịp này chúng tôi cũng thỉnh cầu các quốc gia hội viên trong Hiệp Hội các Quốc Gia Đông Nam Á ra quyết định đổi danh xưng Biển Nam Hải thành Biển Đông Nam Á. Danh từ Nam Hải chỉ áp dụng cho Trung Quốc. Đối với Việt Nam nó có tên là Biển Đông. Đối với Tân Gia Ba, Nam Dương, Mã Lai và Brunei nó là Bắc Hải. Đối với Phi Luật Tân nó là Biển Tây.

Hơn nữa danh xưng Nam Hải có thể bị ngộ nhận và giải thích sai lạc là Biển của Trung Hoa về phía Nam.

Hãy trả Caesar những gì của Caesar.
Và hãy trả Biển Đông Nam Á cho các Quốc Gia Đông Nam Á.

Dear Mr. President:

On behalf of the California Vietnamese Lawyers Association, I would like to submit for your consideration on the Spratly conflict.
Seven years ago there was a naval battle between China and Vietnam in the Spratly Islands. China’s declaration of sovereignty over the Paracels and the Spratlys and their occupation by Chinese navy have sparkled conflict with Vietnam and the Philippines.
Recently, the incidents at Mischief Reef, Half Moon Shoal, Sabina Shoal and Jackson Bank on the Philippine continental shelf have threatened the security of the area and the freedom of navigation in the South China Sea.
At Vanguard Bank called Tu Chinh or Wanan Bei, China and Vietnam are claiming a potentially oil rich tract that China awarded to Crestone Corporation three years ago. That tract lies on Vietnam’s continental shelf about 190 nautical miles southeast of Ho chi Minh City.

The Spratly Islands, east of the disputed Crestone contract area, are contested by a number of countries including China, Vietnam, the Philippines, Malaysia, Brunei and Taiwan.
The "U Shaped" area of Nan Hai (South Sea) known as the "Dragon Tongue" claimed by China as "Hainan Special Administration District" encompasses 80% of the South China Sea, eastward to the Philippines, westward to Vietnam and southward to Malaysia, Brunei and Indonesia, the farthest spot having a distance of 1,100 nautical miles (2000 Km) from mainland China. By doing so, China has considered the South China Sea as its "internal waters", the same way as the Roman Empire called the Mediterranean Sea "Mare Nostrum" (our sea).
By international law, pursuant to Article 57 of the United Nations Convention on the Law of the Sea (1982) (LOS Convention), all coastal states, have been granted exclusive fishing rights in the Exclusive Economic Zone extending 200 nautical miles from shore.
Article 76 of the LOS Convention gives coastal states exclusive rights to drill for oil and gas in the continent shelf up to 350 nautical miles from their coasts. The continental shelf comprises the sea bed and subsoil of the submarine areas that extend throughout the natural prolongation of its land territory to the outer edge of the continental margin, or to a distance of 200 nautical miles from the baselines. For those coastal states who have not-declared a continental shelf of up to 200 nautical miles from the baselines, they are entitled to it ab initio, ipso facto and ipso jure under customary international law, and the 1982 Law of the Sea Convention to which they are signatories (See the Libya/ Malta Continental Shelf Case, ICJ Report 1985, 13). These are the cases of the Philippines, Indonesia, Singapore, Malaysia, Brunei and China (Vietnam has declared its continental shelf of 200 nautical miles from the baselines in 1982).
That 200-nautical miles continental shelf is called the Legal Continental Shelf.
Article 77 of the LOS Convention gives sovereign and exclusive rights to the coastal states over the continental shelf:
1. The, coastal State exercises sovereign rights over the continental shelf for the purpose of exploring it and exploiting its natural resources.
2. These rights are exclusive in the sense that if the coastal State does not explore the continental shelf or exploit its natural resources, no one may undertake these activities without the express consent of the coastal State.
3. The rights of the coastal State over the continental shelf do not depend on occupation, or on any express proclamation.
Concerning the drilling on the continental shelf, Article 81 of the LOS Convention provides that "the coastal State shall have the exclusive right to authorize and regulate drilling on the continental shelf for all purposes".

The Rule Pacta sunt servanda applies for the observance of treaties.
Article 26 of the Vienna Convention on the Law of Treaties (1969) declares that "every treaty in force is binding upon the parties to it and must be performed by them in good faith".
The United Nations International Law Commission in its commentaries to this rule, characterized it as a "fundamental principle of the law of treaties, perhaps the most important principle of international law". (See 1966 Report on the I.L.C. reproduced in 61 Am. Int’l L. 248 at 334)(1967).
According to the rule of supremacy of international law, the rights and obligations-which a state has, by international law are, on the international plane, superior to any rights or duties it may have under its domestic law. Article 27 of the Vienna Convention provides that "a party may not invoke the provisions of its internal law as justification for its failure to: perform a treaty". That failure to perform would constitute a breach of international law requesting remedies with provisional measures in case the urgency of the situation required it.
Therefore, China should not invoke its domestic Law of the Sea promulgated in 1992 to encroach upon the Vietnamese and Philippine Continental Shelves and the whole Spratly and Paracel archipelagoes. These violations of the law of the sea should be submitted to the International Court of justice or the International Tribunal For the Law of the Sea for the resolution of disputes in case the parties do not reach an agreement by negotiation and conciliation. The International Court Tribunal has jurisdiction over the matters relating to the interpretation or application of the LOS Convention. Until December 1982, the Convention was signed by 119 states. It has come into force on November 16, 1994 after its ratification by 60 states.

On July 29, 1994, the United States signed the Agreement Relating to the Implementation of Part XI of the LOS Convention. Last October, President Bill Clinton transmitted a letter to the U.S. Senate asking its consent to accession to the LOS Convention.

The settlement of these disputes by peaceful means such as negotiation. conciliation and judicial proceed 9 would keep Southeast Asia from becoming another Middle East. With the rule of law taking the place of the use of force, Southeast Asia may soon experience a period of peace, stability, cooperation and prosperity.

I would like to seize this opportunity to propose that you change the name "South China Sea" to "Southeast Asian Sea'. The appellation of South Sea (Nan Hai) is good only for China; the East Sea (Bien Dong) applies only to Vietnam. As for Singapore, Indonesia, Malaysia and Brunei, it should called North Sea; and for the Philippines, the correct name be West Sea.
Furthermore,, the name South China Sea could be interpreted erroneously as the Sea of China in the South.

Let us give to Caesar what belongs to Caesar, and give Southeast Asian Sea to the Southeast Asian countries.
